Recovery of an estate debt
Under the Limitation Act 1969 (NSW) a person is given a specified period of time to take action to recover money due to him/her. The time is:
– 6 years commencing from the date the debt first became payable (s. 14(1)(a));
– 6 years from the last repayment made as long as it was made within 6 years of the date the debt first became payable (s.54);
– 6 years from any written confirmation by the payer that he/she owes money to the payee for the debt as long as the confirmation was made within 6 years of the date the debt first became payable (s.54).
